After such a long and drawn out lawsuit against Nintendo, being accused of infringing on a patent asserted by Anascape, Ltd. The courts and jury have announced that it does not believe the Nintendo?s Wii-Mote nor Nunchuck controllers infringe on any of Anascape?s patent.
The odd thing is that the jury found that the Classic Controller for the Wii, the WaveBird and standard controllers for Nintendo GameCube did infringe on the patent. As I read on, the sad but true issue is that today?s decision completely reversed the jury?s findings of infringement.
?In 2008, the jury determined that the Wii Remote and Nunchuk did not infringe,? said Nintendo of America General Counsel Rick Flamm. ?Today the Federal Circuit?s ruling confirmed that none of Nintendo?s controllers infringe. We appreciate that our position has been vindicated.?
Not quite sure how that is, but at this point Nintendo is cleared of all charges and Anascape, Ltd. is out of a ton of legal costs. WoW?
I think Nintendo knew that it did infringe on the patent but also knew that the case was against the Wii-Mote and Nunchuck controller as a loop hole. But that?s just my opinion not any type of fact.
